1. Operator and scope
Ficard at https://ficard.pages.dev is operated by Vinod Balan in India. In these Terms, “Ficard,” “we,” “us,” and “our” refer to that operator.
These Terms apply to the web application, installable progressive web application, standalone builds, documentation, updates, and related pages supplied under the Ficard name.
2. Acceptance of these Terms
You accept these Terms when you access, install, or use Ficard. You also agree to the Privacy Policy, which explains how the application handles local data, OAuth tokens, and cloud backups.
If you use Ficard on behalf of an organisation, you confirm that you are authorised to accept these Terms for that organisation.
3. Eligibility and responsibility
You must have the legal capacity to agree to these Terms. If you are below the age at which you can enter a binding agreement in your jurisdiction, use Ficard only with the involvement and permission of a parent or legal guardian.
You are responsible for ensuring that your use of Ficard complies with laws, workplace policies, cloud-provider requirements, and any obligations that apply to financial or personal information you enter.
4. Licence and permitted use
Subject to these Terms, you receive a limited, non-exclusive, non-transferable, revocable licence to use Ficard for lawful personal or internal organisational finance tracking.
You may create accounts, transactions, reminders, categories, people records, local exports, and cloud backups. You may make reasonable backup copies of the application files for your own deployment.
You may not sell, sublicense, rent, commercially redistribute, misrepresent ownership of, or use Ficard to provide an unauthorised competing hosted service unless you have written permission from the operator.
5. Financial-information disclaimer
Ficard does not provide banking, payment processing, investment advice, credit advice, accounting, tax advice, legal advice, debt collection, or fiduciary services. It does not independently verify bank balances, transaction descriptions, card statements, exchange rates, tax treatment, repayment obligations, or investment values.
Charts, running balances, reminders, recurring entries, card utilisation, borrowed or lent totals, and other calculations depend on data and settings supplied by you. They may contain errors, omissions, duplicated entries, missed schedules, rounding differences, or outdated information.
You must verify important figures against official statements and obtain qualified professional advice before making financial, tax, legal, credit, or investment decisions.
6. Your data and backup responsibility
You retain ownership of financial records, notes, tags, categories, people data, imported SMS text, and other content you enter into Ficard.
Ficard stores its working dataset in the browser. Browser storage can be erased by clearing site data, reinstalling a browser, using private-browsing mode, device failure, storage eviction, malware, or browser and operating-system changes.
- You are responsible for maintaining current JSON exports or cloud backups.
- You are responsible for checking that a backup completed and can be restored.
- You are responsible for the accuracy, legality, and appropriateness of information you enter.
- You should not enter another person’s sensitive information unless you have a lawful reason and appropriate permission.
Deleting data in Ficard does not automatically delete JSON files already downloaded or stored in Google Drive or OneDrive.
7. Google Drive and OneDrive
Cloud backup is optional. When you connect a provider, authentication occurs on Google’s or Microsoft’s official sign-in service. Ficard does not ask for or receive your Google or Microsoft password.
You authorise Ficard to create, update, list, and delete backup files only as required by the backup mode and retention settings you select. You may disconnect the provider or revoke access through the provider’s account-security settings.
Cloud backup depends on your internet connection, browser support, active provider session, available cloud storage, provider APIs, account policies, and provider availability. Daily backup in the browser is best-effort: if Ficard is closed at the scheduled time, it may run a catch-up backup the next time the application opens.
Your use of Google Drive or OneDrive is also governed by the relevant provider’s own terms and policies. Ficard is not sponsored, endorsed, or operated by Google or Microsoft.
8. Account and device security
You are responsible for protecting your device, browser profile, screen lock, cloud account, authentication methods, and exported backup files. Anyone with access to the same unlocked browser profile may be able to view or change Ficard data.
Do not share OAuth tokens, browser-storage exports, or unencrypted financial backups with untrusted persons. Disconnect cloud providers before transferring a device or browser profile to another person.
No method of local storage, browser execution, electronic transmission, or cloud storage is completely secure. Report suspected Ficard security issues privately to tapvinod@gmail.com.
9. Prohibited use
You must not use Ficard to:
- break any law, regulation, court order, or third-party right;
- store, process, or distribute information obtained unlawfully;
- gain unauthorised access to an account, device, cloud folder, or service;
- introduce malware, exploit vulnerabilities, bypass security controls, or interfere with the application or its hosting;
- mislead another person about a transaction, debt, repayment, balance, or financial position;
- scrape, overload, or abuse Google, Microsoft, hosting, or other third-party services;
- use the application for fraud, money laundering, sanctions evasion, or other harmful activity.
10. Availability, updates, and compatibility
Ficard may be changed, updated, suspended, or discontinued. Features can differ by browser, operating system, region, provider account type, installed-PWA support, and permissions.
The “Load latest version” function attempts to clear Ficard’s web cache while retaining browser localStorage, but browser behaviour is not guaranteed. You should export a backup before major updates, browser resets, device migrations, or storage changes.
We do not guarantee uninterrupted operation, exact reminder timing, automatic recovery, permanent backward compatibility, or support for every browser or third-party API change.
11. Intellectual property
Ficard’s name, icon, visual design, interface, documentation, and application code are protected by applicable intellectual-property laws unless a separate licence expressly says otherwise.
Your data remains yours. These Terms do not transfer ownership of your finance records to the operator. Feedback or suggestions you voluntarily provide may be used to improve Ficard without payment or obligation, provided such use does not identify you or disclose your financial records without permission.
12. Disclaimers
To the maximum extent permitted by applicable law, Ficard is provided on an “as is” and “as available” basis, without warranties of accuracy, merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, data preservation, or error-free operation.
We do not warrant that reminders will arrive at a specific time, that SMS parsing will be correct, that recurring entries will always be created, or that cloud providers will accept, retain, or restore a backup.
Nothing in these Terms excludes any warranty or consumer right that cannot lawfully be excluded.
13. Limitation of liability
To the maximum extent permitted by law, the operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for loss of data, profit, opportunity, reputation, savings, business, or expected benefit arising from use of or inability to use Ficard.
This includes loss caused by inaccurate data, missed reminders, browser-storage deletion, failed imports or exports, device loss, unauthorised local access, provider outages, expired authentication, API changes, corrupted backup files, or decisions made using Ficard’s calculations.
Where liability cannot be excluded, it will be limited only to the extent permitted by applicable law. These limitations do not apply where exclusion or limitation is prohibited, including any liability that cannot be waived under applicable consumer law.
14. Suspension and termination
You may stop using Ficard at any time. You can remove local data through the application or browser settings, revoke cloud access, and delete cloud backup files separately.
Access to a hosted Ficard deployment may be suspended or terminated where reasonably necessary for security, maintenance, legal compliance, misuse prevention, provider-policy compliance, or discontinuation of the service.
Sections intended by their nature to survive termination—including ownership, disclaimers, liability, governing law, and responsibility for existing backups—will continue to apply.
15. Governing law and disputes
These Terms are governed by the laws of India, without excluding mandatory rights that may apply to you under consumer or other applicable law.
Before starting formal proceedings, please send a clear description of the dispute to tapvinod@gmail.com and allow a reasonable opportunity to resolve it informally. Unresolved disputes may be brought before a court of competent jurisdiction in India, subject to any non-waivable jurisdiction or dispute-resolution rights available to you.
16. Changes to these Terms
These Terms may be updated when Ficard’s functionality, cloud permissions, business model, hosting, security requirements, or applicable obligations change. The updated page will show a revised effective date and version number.
Material changes may be announced in the application. Continued use after updated Terms take effect constitutes acceptance where permitted by law. If you do not agree to an update, stop using Ficard and export or delete your data as appropriate.
